Contact Agreement

The Social Shark is committed to providing excellent digital services to clients. The Social Shark may submit website links to search engines, directories and other online submission portals. The client hereby authorizes The Social Shark to showcase their completed client websites.

It is the responsibility of clients to make sure that they provide accurate information. Clients will need to agree to give relevant contact details for business correspondence and clients should be active and responsive to any communication. If clients do not respond to business correspondence within a reasonable time frame, The Social Shark reserves the right to suspend outstanding projects or campaigns without contact.

Limited Right to Use

This web site is owned and operated by The Social Shark. Unless otherwise specified, all materials on this web site are the property of The Social Shark and are protected by copyright and other applicable laws. You may, view, print and/or download one copy of the materials from this web site on any single computer solely for your personal, informational, non-commercial use, provided you keep intact all copyright and other proprietary notices. No materials published by The Social Shark on this web site, in whole or in part, may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without prior written permission from The Social Shark. Additions and Changes

Additional charges will be applicable for change requests made after the initial project brief agreement. Such requests will be considered as an additional work order. The Social Shark is not under any obligations to provide any additional work outside the initial agreed project scope. Additional work will be billed as an additional cost after the client agrees to get billed for the additional updates.

The changes will be considered as a new order and mutual agreement has to take place before additional work is carried out. However, The Social Shark does offer a little leeway on small changes or corrections, but the decision for additional charges will be at the sole discretion of our company and charged upon agreement by the client.

Date of Completion

The Social Shark will require complete cooperation from the clients in order to get the job completed on time. Various projects and campaigns will be thoroughly discussed prior to launch and a reasonable time frame is to be agreed upon with the client before taking up the project.

If the client is unable to provide all the information required for completing the project brief for a period of one month after the billing, The Social Shark reserves the rights for suspending the project. It could also result in complete cancellation as well. If for any reason, the project gets delayed, new completion dates will be discussed with the client.

Fee Payment

The entire works will be owned by The Social Shark until the client pays the full agreed amount. The client becomes a legal owner only after the complete payment of fees for the contracted work.

Final payments are typically due after the final project delivery. The client agrees upon accepting the project brief that all final payments will be paid within a maximum of 30 days of final project delivery. It becomes the responsibility of the clients to make complete payments before, during, and/or after project milestones.

The Social Shark offers various payment options, accepting MasterCard, PayPal, Visa or money orders. However, if you are unable to pay via the above mentioned options, please feel free to get in contact to discuss other payment options. All payments will be made in Pounds Sterling.

Payment of additional fees applicable for the updates or changes should be completed within 14 days of generating the invoice receipt. Payments made after 14 days will result in an additional 5% of invoice value added to the bill. For every 14 days the invoice remains unpaid, an additional 5% of the invoice value will be added to the bill. If payments are unpaid after 3 months, The Social Shark reserves the right for full ownership of work materials, content and any other source of value created during the working project.

Copyrights and ™

Our policies are strictly against any kind of copyright violations. Therefore, when the client provides informational elements like graphics, images, designs, content, Logos or trademarks, and they will need to guarantee that they own it completely. The Social Shark is not liable to any damages caused due to copyright violations from our clients. The Social Shark stands to stay protected from any kind of conflicts that could arise due to client provided information on the websites.

Subleasing The Copyrights

After the payments and the project works are completed, the client will be awarded with a complete ownership of the work. However, you do not have reserve any rights to sublease, publish, transfer the completed product to any third parties without prior consent from The Social Shark. They will remain under the ownership property of the respective owners agreed upon at the time of contract.

Artwork And Web Pages

The purchased services from The Social Shark can be used for personal or business use by our clients. They can incorporate the artwork on other office stationery like business cards, letterheads, or for any kind of advertisements. However, you cannot alter or modify it under any circumstance without intimating as about the same. Sales or distribution of artwork to third parties is not allowed.

The Social Shark reserves the right to publish the artwork of your website as one of our completed projects while marketing our services.

Indemnity

You agree to indemnify, defend and hold The Social Shark harmless from and against any and all third party claims, liabilities, damages, losses or expenses (including reasonable attorney’s fees and costs) arising out of, based on or in connection with your access and/or use of this web site.

Limitation of Liability

In no event shall The Social Shark or its partners be liable for any direct, indirect, special, incidental or consequential damages including, without limitation, loss of profits or revenues, costs of replacement goods, loss or damage to data arising out of the use or inability to use this web site or any linked site, damages resulted from use of or reliance on the information or materials presented on this website, whether based on warranty, contract, tort or any other legal theory even if The Social Shark or its partners have been advised of the possibility of such damages.

Service Refusal

However, we hold the rights to cancel the contract if the terms and conditions set by us are not met by our clients.

Refunds and Cancellation

The Social Shark will refund any costs upon mutual agreement if any work is not carried out to the standard of quality that is communicated. Partial refund might be agreed upon during particular situations or under certain circumstances, but only at the sole discretion of The Social Shark. Any requests for refund after final project delivery will be declined.

Design Credit

The client agrees to include the The Social Shark or a related partner link, including a small logo at The Social Sharks discretion, on the bottom of any web pages that are worked on, for as long as their websites stays live.

Any of the above mentioned terms and conditions is subject to change at the sole discretion of The Social Shark. All as users agree to the above mentioned terms and conditions for the entire contract period with us.
